Services Disputes
The Khan Partnership has a wealth of experience in all types of disputes involving banks and other financial institutions. The members of the team have acted for many years for clearing banks, smaller banks, foreign banks, trade finance houses and asset based lenders, as well as their customers.
We advise upon a broad range of issues, including technical banking matters, financial regulation and contractual claims. Our areas of expertise include:
- enforcement of security over land and all disputes relating thereto such as claims of undue influence, non est factum, invalidity, priority, and marshalling
- enforcement of security over other assets of companies and individuals, including debentures and chattel mortgages
- guarantee and indemnity claims
- debt recovery, including all aspects of judgment enforcement
- conversion and breach of mandate claims
- breach of contract , negligence and constructive trustee claims
- reporting obligations under the Proceeds of Crime Act
- all disputes arising from the recovery of debts by financiers following assignment by their customers
- regulatory disputes
Much of our work includes an international element, for example acting for companies incorporated abroad or considering the effect of security taken here over assets located elsewhere.
