Tim is an experienced litigator and has advised on a wide range of commercial disputes including contractual, banking, economic tort, fraud and financial services disputes. Since starting at The Khan Partnership Tim has been acting for a hedge fund in a LCIA arbitration in relation to a disputed redemption against a major UK bank. Investment banking matters Tim has advised on include:
- A complex fraud claim involving the purchase of an offshore bank and representations made during the sale process concerning the nature of the offshore bank’s asset base.
- An internal investigation of traders based in Japan and obtaining an order freezing the assets of a trader in three jurisdictions.
- A bank under investigation by financial regulators following the high profile collapse of a multinational company.
Tim’s arbitration and insolvency experience includes advising on a dispute between the Ministry of Defence and an insolvent salvage company hired to recover the wreckage of an RAF jet from the Irish Sea. In addition to commercial dispute resolution Tim also advises on regulatory and public law disputes, with a particular emphasis on environmental, energy and rail.
Achievements in this area include persuading:
· The Office of Rail Regulation to grant the UK's largest rail freight operator a long- term track access agreement.
· An energy company to withdraw a notice that purported to require that the trees and hedges growing beneath its power lines be cut down.
Most recently, Tim provided legal advice on EU environmental and climate change legislation, UK planning law and judicial review to the “no-new coal” campaign. A campaign that persuaded the UK government to adopt a more progressive policy for granting planning permission to new coal power stations, including E.on’s controversial Kingsnorth project, and also to fund the development of carbon capture and storage technology.
Tim graduated from Nottingham University (LLB) and Nottingham Law School. After completing his training contract with Macfarlanes he spent seven years with leading international law firm Freshfields Bruckhaus Deringer.
Tim has cycled from Argentina to Alaska as part of an 18 month trip to raise money for Medecins Sans Frontieres.
