The Khan Partnership has an exceedingly busy litigation practice. We frequently appear in courts and tribunals of all descriptions on both our own account and as instructing solicitors to independent members of the bar.
Our success is a combination of two factors: thorough preparation and understanding of the issues involved. We determine a strategy from the outset and are proactive throughout the litigation process. Our experience in tax litigation from both sides of the fence means that we can often anticipate issues well before they arise and, as a result, we will have a well thought-out plan for dealing with those issues.
The VAT and Duties Tribunal
The Khan Partnership team has unparalleled experience appearing in the VAT & Duties Tribunal in relation to VAT, excise and customs matters. We are represented at the invitation-only VAT & Duties Tribunal User Group: an acknowledgment that our firm is one of the most frequent litigations in that forum.
Our experience in VAT & Duties Tribunal litigation will ensure that any litigation we conduct on your behalf will draw on our knowledge of Tribunal processes to give you as fast and effective result as possible.
We are particularly knowledgeable in the area of Missing Trader Intra-Community (MTIC) fraud. Hassan has been at the forefront of this area for the past five years. He successfully conducted Bond House Systems Limited [link the ECJ judgment], the leading case in this area, in the European Court of Justice. He is currently involved in a number of MTIC cases in the VAT and Duties Tribunal and in the High Court [link to other cases/recent developments page?].

Judicial review
Government decision makers must not exceed the bounds of their authority when making decisions. Revenue authorities are no exception. From time to time, it may be necessary to seek to judicially review a decision which has been made in a particular case. This could occur, for example, where policy has been applied inflexibly or where a decision maker has failed to take relevant matters into account or vice versa. The Khan Partnership has considerable experience in seeking judicial review of these decisions in the High Court.
